California Widow Files Mesothelioma Lawsuit

On Sept 28, 2008 Virginia Schmidt of California filed an asbestos suit in Madison County Circuit Court stating that her husband Oswald Schmidt had contracted mesothelioma, a disease that was wrongfully caused. Oswald was diagnosed with mesothelioma on December 12, 2007 and died from the disease a few months later. The suit claims that Oswald’s disease was caused when he was exposed to asbestos at work. From 1949 to 1989 Oswald worked as a welder at various locations throughout Illinois and Kansas.

The suit claims that the disease was caused as Oswald was exposed to, inhaled or ingested asbestos fibre from the products made, sold or serviced by the defendant companies. In an 11 count lawsuit she is seeking compensatory damages in excess of $200,000 and other relief for the mental and physical pain suffered by Oswald before his death.

Washington Mesothelioma Patient Files Suit

On Sept 29, 2008 Susie Powell of Washington filed an asbestos suit in Madison County Circuit Court against 13 defendant Corporations stating that she  has contracted mesothelioma, a disease that was wrongfully caused. She was diagnosed with mesothelioma on July 8. The suit claims that Susie’s disease was caused as she was exposed to asbestos at work. From 1961 to date she worked as a glass figurine maker and auto salvage worker. Her family member James Duman worked from the 1950s to the 1960s as a laborer in various locations.

The suit claims that the disease was caused as Powell was exposed to, inhaled or ingested asbestos fibre from the clothes of Duman. He was exposed to asbestos fibres from the products made, sold or serviced by the defendant companies. In a 2 count lawsuit she is seeking sums in excess of $50,000, compensatory damages in excess of $50,000 and other relief.

Victim’s Widow Files Mesothelioma Lawsuit

On Sept 26, 2008, Louise Warszawski of Rhode Island filed an asbestos suit in Madison County Circuit Court against 58 defendant corporations. The suit states that her husband John Warszawski contracted mesothelioma, a disease that was wrongfully caused. John was diagnosed with mesothelioma on May 28, 2005 and died from the disease on September 26, 2006. The suit claims that John’s disease was caused by exposure to asbestos at work. From 1945 to 1989 John worked as a fireman, laborer, and assembly line laborer at various locations throughout Illinois, Rhode Island and Massachusetts.

The suit claims that the disease was caused as John was exposed to, inhaled, or ingested asbestos fibre from the products made, sold or serviced by the defendant companies. In an 11 count lawsuit, Mrs. Warszawski is seeking sums in excess of $300,000, compensatory damages in excess of $250,000 and other relief for the mental and physical pain suffered by John before his death.

Mass Asbestos Lawsuit in Illinois

Around 150 people have filed a mass asbestos lawsuit after the victims developed the devastating form of lung cancer known as mesothelioma. The victims claim that they were given misleading information about asbestos, causing their current condition.

Filed on October 14th, the lawsuit includes various defendants such as Metropolitan Life Insurance Inc. and John Crane Inc. The victims are claiming that these companies worked to mislead the public on the dangers of asbestos by providing reports that created a “favorable atmosphere for the continued sale and distribution and use of asbestos.”

Abatement Process Still Leaves Risk of Asbestos Exposure

Ridding a building of asbestos, also known as the process of abatement, is vital to the safety of all of those who utilize the building. There is, however, a safe and unsafe way to go about removing asbestos. Unfortunately, the safe way to rid a building of asbestos can be very expensive and time consuming. Some companies or building owners may opt to just begin ripping up the building, however, this is not advised.

The Old Peerless Woolen Mills complex located in Rossville, Georgia, is currently undergoing the process of abatement, after asbestos was found during a rennovation project. The process has been delayed, sparking an argument over the building’s safety. Workers first noticed a fine white powder in various locations surrounding the building. Believing that this powder was a sign of asbestos, the workers informed the building owner.

The president of one of the building’s tenents (Tek-Mak) sent the powder away to be tested. The powder was tested and came back positive for asbestos. When the owners of Tek-Mak took the issue up with the building owner, they were given a note of eviction.

Arguments continue to surround this issue, however, the asbestos found in the building remains a serious threat to the safety of workers and the inhabitants of the building.
