Family Members’ Clothing Leaves Arkansas Woman with Mesothelioma

In April of 2006, Tammy Schwartz of Arkansas was diagnosed with mesothelioma.  Schwartz never worked at a job that was known for a high risk of asbestos exposure, nor does she make it a habit to hang around environmental dumping grounds or demolition zones.

In a surprising twist, Schwartz, in a lawsuit filed against several defendants, claims that she was exposed to asbestos by way of her husband’s and her father’s clothing.  Shcwartz’s father worked as a pipefitter for many years when she was a child, and her husband was also a pipefitter.  Pipefitters are known to generally be at risk for asbestos exposure, as many pipe ducts and other plumbing products have historically contained this substance.

The worst part of the story for Schwartz is that mesothelioma has no cure, and is generally a terminal disease that progressively damages and ultimately debilitates the respiratory system.  Specifically, the filed complaint alleges that the defendants:

  1. Included asbestos in their products when they knew or should have known of its toxic effects
  2. Included asbestos in their products when there were other materials that would suffice
  3. Failed to provide proper warning about the dangers of asbestos to people working with their products
  4. Failed to perform tests on their products to determine the hazards to which workers might be exposed
