Altus City Council has settled a lawsuit in which they allegedly used unsafe material as fill for a drainage project. The city now owes Paul and Shannon Burns, owners of the Owl’s Roost Cafe, $19,441 and must continue to pay for clean up.

Because the Burns don’t believe that the city will do an adequate job of removing the unsafe material, believed to contain asbestos, from the site, the city must contract out the job and continue to pay for it. The clean up project involves removing the fill, replacing the material, and disposing the unsafe  material safely.

The  lawsuit filed in May in Franklin County Circuit Court alleges that fill material used when installing the 48″ culvert that crosses the Burnses’ property, the city used material that contains asbestos from a nearby building demolition site. The suit claims that the city knew at the time of the construction project that hazardous material was present. It also claims that irreparable harm was done to the property.
