Donald Sims recently passed away after developing the dangerous cancer known as mesothelioma. His wife has now filed a lawsuit against his former employer, Du Pont, claiming that the company “maliciously” exposed her husband to “toxic and carcinogenic dusts.”
According to the lawsuit, Sims was exposed to various dangerous toxic and carcinogen dusts, including asbestos, during his time as an employee of Du Pont. The suit claims that Du Point was fully aware of the dangers of the dusts and did nothing to warn their employees of the dangers. It also claims that Du Pont negligently failed to provide Sims and other workers a safe working environment.
Mrs. Sims is seeking punitive damages, as well as mental anguish, medical expenses, loss of earning capacity and loss of consortium.
