A toy maker and various retailers were sued after a California asbestos awareness group stated that one of their toys, the “CSI: Crime Scene Investigation” toy kit, contained asbestos. The toy is based off of the popular television show and includes a toy version of a crime scene kit.
The awareness group alleges that tests show large amounts of tremolite asbestos, the most deadly form of asbestos, in the fingerprint powder dust of the toy. The group claims that the manufacturer and several retailers failed to properly warn the public about the hazardous material found in the toy, as required by law.
Although the toy was pulled from shelves, the manufacturer and retailers have not been able to duplicate the awareness group’s findings in studies. Until the matter is settled, the toy remains off of the shelf.

A man from Utah has been diagnosed with mesothelioma after working in the auto industry as a mechanic since 1978. Claiming that the disease was wrongfully caused by his past employers, the man argues that his exposure took place during his employment and during home and automotive repairs.
He recalls being exposed to the dangerous substance and the many times he inhaled or absorbed the asbestos fibers that came from the many products he worked with or around. The man has named a total of 59 defendant corporations in his lawsuit.
The man claims that his disease was caused by corporations who did not properly manufacture their products, did not warn consumers about the dangers associated with their products, and failed to provide any instructions on how to safely handle the dangerous products.
The man seeks damages to pay for the costs of his treatment. He also suffers physical pain, loss of earnings, and loss of potential earnings.

The wife of a man who was recently diagnosed with Mesothelioma is speaking out. At the age of 16, the man began to work as a mechanic, spending long hours repairing brake pads and clutches. While asbestos was not banned at that point in time, she claims that right up until last year her husband was still being exposed to the dangerous substance despite laws against asbestos.
The woman claims that her husband began to feel out of breath and “full”, or bloated, about a year ago. At the time, her husband was quitting his addiction to cigarettes so the couple ignored the signs, writing them off as a product of the smoking. Sadly, the cigarettes were not the cause of the man’s symptoms and he was diagnosed with mesothelioma shortly after. The doctor who treated the man told the couple that 85% of mesothelioma victims work in the auto industry.
The names of the couple have been omitted as they organize their lawsuit against the man’s former employers.

W.R. Grace & Co. has reached an agreement to resolve current and future asbestos claims against the company, which would allow it to emerge from bankruptcy without further obligations for asbestos injury.
Asbestos contamination from a former W.R. Grace vermiculite mine in the northwestern Montana town of Libby has been blamed for sickening hundreds of people, some fatally. The agreement will require the company to pay $250 million into a trust fund for asbestos victims, followed by deferred payments of $110 million per year for five years beginning in 2019 and $100 million per year for 10 years beginning in 2024.
Other contributions to the trust fund are $1.2 billion from Sealed Air Corp. and $100 million from Fresenius Medical Care Corp., both formerly affiliated with Grace. The trust will be able to file claims against $917 million in product liability insurance purchased by Grace.
Grace filed for bankruptcy protection in April 2001. The company had been named in 110,000 asbestos personal injury claims. The company will be able to emerge from bankruptcy late this year or early next year, at which point the trust fund would be set up and trustees appointed. A majority of the asbestos injury claims against Grace are related to a spray-on fireproofing product the company manufactured.
From 1923 to the early 1990s, millions of tons of the asbestos-contaminated vermiculite ore were shipped from the mine near Libby to about 270 processing plants across the United States for use in insulation, fireproofing, gardening and other products.
